👋 Hello there! Welcome on Soons.
Soons is a social network that allows you to join your friends in real life. How does it work? Tap on friends, they receive a "Ping" notification asking them if they are free. If they answer "Pong", a chat opens so you can join each other. If it's "Pass", it will be for next time.
It's a new generation application, designed so that you spend as little time as possible on your phone and as much time as possible in real life, with your friends, around a fun activity. So that digital is really at the service of the real.
Soons is an online solution accessible from the Soons application available on GooglePlay or Apple Store (the "App").
The Soons App is published by Soons, a simplified joint stock company whose registered office is located at 5 Avenue du Général de Gaulle, 94160 Saint-Mandé and which is registered under the number 901 897 868 in the Créteil Trade and Companies Register ("Soons SAS").
🤷 1. Can you use the App?
You must be at least 13 years old to become a Soons User. If you are not, you cannot create an Account or use the App and its Services. If you are between 13 and 16 years old, depending on the country where you live, we may need permission from your legal guardian. Finally, depending on your country, you must be old enough to have the right to consent to the processing of your data. Entering into a contract
If you meet the age requirement you can use the App and its Services. By creating an Account on the App you are entering into a contract with our Company and agreeing to abide by the Terms and all applicable local, national and international laws, rules and regulations.
The Services are to be used for personal, non-commercial purposes. However, if you wish to make commercial use of them, please feel free to email us at firstname.lastname@example.org to discuss.
👤 2. Creating your Account
To be able to use the App and its Services you need to create an Account that is specific to you. It's very simple, you just have to follow the steps in the app when you first connect. The information you give us must correspond to your own identity and must not be false or erroneous. Here is the important information related to your account:
👤 To create your Account, you must fill in your last name, first name (you can also add a profile picture, but it is optional). This is what will be displayed when you use the App and will allow you to be easily recognized by your Friends. Don't forget: most of the information in your profile is public and will be visible to the Soons Community. This means that your profile can be seen by your Friends, your Dates and the Soons Community.
☎️ You must also provide a valid phone number. To ensure that no one else uses your number, we ask that you validate it during creation. To do this, we send a text message containing a verification code to the number you provide. To finalize your registration, you will have to enter this code in Soons. To keep your data if you change your phone number, contact us at email@example.com.
✉️ By entering your email address (optional), you authorize the sending of any communication related to the App to this email address. This information is optional. You can of course unsubscribe at any time via a link at the bottom of each email received.
📍 Soons is an application that allows you to create events or join your friends right there, right now. To make it as easy as possible to use, Soons offers you to use the geolocation of your phone, when using certain features of the App. When you agree, we access and store your location data in order to provide you with the Services.
At any time, you can enable and disable the use of location data in your phone settings.
Of course, we understand that you may not want Soons to have access to your location data. That's why access to your location is not mandatory to use the main features of the App.
Furthermore, your location on Soons is private, it is not shared with other Users of the App, unless you request it.
📬 Soons also offers you the option of enabling notifications so that you are informed of activity on the App that concerns you, when your friends offer you to join them or invite you to their events for example, or when you receive a message, request or acceptance as a friend.
📒 Soons finally offers you to connect the App to your phone's address book so that you can :
- see and friend your contacts who are already on Soons.
- invite your contacts who are not yet on Soons.
🔒 Once you have created your Soons account, you are responsible for the activity that takes place on it and the security of your Account. Since creating a Soons account does not require a password, be sure to protect your phone with a strong password. If you suspect fraudulent use, or hacking of your account, please notify us immediately at firstname.lastname@example.org so we can help you correct the situation.
🚀 3. The App Services
Once you have created your Account, you can use the Soons Services on your phone via the App. The Services, i.e. the functionalities, allow you to:
🔍 Consult community profiles
You can search for a User and view the public information of Users of Soons (the "Community"). In the same way a User can see and view your public information on Soons, namely, your first and last name, your profile picture, your list of friends and emojis from events you have done in the past, which you collect as you use the App, such as badges.
💛 Add your Friends
The people you request as friends and who accept your request, or who request you as friends and you accept, become your friends on the App ("Friends"). You can then join each other through the "Ping" feature.
👤 Consult your profile
Your friends can view your "private" profile that you want to fill in.
To see a friend today just tap on his profile picture. This will send him a Ping: a notification asking him if he is available. He then has one hour to answer. Either Pong if he is available, or Pass if he is not available.
If a person to whom you have sent a Ping replies Pong, then that person is available to see you. From that moment on a conversation opens for the day, so you can meet up.
If a person to whom you have sent a Ping replies Pass, it means that this person is not available. A conversation opens temporarily so you can exchange a few words, then closes. Soons is not a chat app.
💬 Chat by message
You can chat with other Users if they are your Friends via a live messaging feature. This is not possible otherwise.
🔧 Publish content
As a User any data you transmit to us on the App is content (the "Content"). This includes, but is not limited to, photos, messages, data, events published on the App and/or created through the App Services.
💔 Removing Friends
You can remove a person from your Friends at any time. He or she will no longer be able to use the "Ping" feature with you, nor chat, nor access the information available to your Friends only.
💎 4. Your rights and obligations
Soons grants you a personal, free, non-exclusive, limited and non-transferable, revocable license, valid worldwide, which has the sole purpose of allowing you to access the Services. As a User, you agree to use the App and the Services in good faith, in accordance with the Terms, and in a responsible manner so as not to misuse the App or cause harm to other Users, third parties and/or our Company.
You expressly agree not to:
- Infringe in any other way the rights of third parties or the laws and regulations in force.
- Use the trademarks, logos, designs, photos, videos or other materials contained in our Services;
- copy, archive, download, distribute, publish, broadcast, perform, display, make available, or use all or any part of the Services (or the content of the Services) except as permitted in these Terms;
- use the Services for commercial purposes without our consent.
To keep the App a safe space, you also agree not to:
- Transmit a computer virus, worm, Trojan horse, logic bomb or any other malicious or malicious file, program or form of code intended to damage, interrupt, suspend, destroy and/or limit the functionality of any computer or telecommunications equipment.
- Impersonate any other person, User, or Soons employee or representative, and/or use the App to post or transmit any content that may harm or disparage Soons in any way.
- Use data mining, robots or similar data gathering and extraction tools in connection with the App.
- Interfere with the operation of the App, servers and/or network connections to the App.
- Violate any requirements, procedures, policies or regulations relating to networks connected to the App.
- Modify, adapt, sublicense, translate, sell, reverse engineer, decompile or disassemble any part of the App.
- Attempt to gain unauthorized access to the App (or any portion thereof).
- Use any device or software to interfere or attempt to interfere with the proper working of the Application; or take any action that imposes a disproportionately large load on our infrastructure.
Respect for Other Users or Third Parties
You may not use the Services, the tools provided by the Services, or any content on the Services, or allow anyone else to use them :
- in a manner that impersonates another person
- in a manner that violates or infringes upon the image rights, privacy rights, copyright, trademark or other intellectual property rights of another person
- in a manner that is defamatory, abusive, intimidating, harassing, malicious, obscene, inciting discrimination, hatred, racist, xenophobic, anti-Semitic, advocates war crimes, may incite the commission of a crime, misdemeanor, act of terrorism, is contrary to the safety of minors;
- in a way that solicits Users or allows them to be sent unwanted messages
- for advertising or commercial purposes or for purposes of unfair competition, in order to publish or facilitate the transmission of advertising, commercial solicitations, spam, "chain letters", "pyramid schemes" or to collect information, data or Content on other Users without their authorization.
Consequences of Violation
In the event of a breach of any of the obligations set forth in these Terms, Soons reserves the right to unilaterally terminate its contract with you as set forth in the "Termination" section of the Terms.
These Terms constitute the entire agreement between you and Soons and supersede all prior agreements. They do not create or confer any beneficial rights on any third party. If we fail to enforce any provision of these Terms, this shall not be deemed a waiver. We reserve all rights that we have not expressly granted to you. You may not assign your rights and obligations under these Terms without our consent.
👮5. Confidentiality and protection of your personal data
Your personal data is any information that relates to you or allows you to be identified. Because this information is about you, we make sure that you retain control of it.
Soons takes the confidentiality of the information you provide to us and the protection of your personal data very seriously. The information you are asked to provide when registering on the App is necessary and mandatory for the creation of your Account. It may be used by Soons for the administration, management and animation of the Service.
Soons assures you that your personal information will be collected and processed with respect for your privacy in accordance with the French law n°78-17 of January 6, 1978 relating to data processing, files and freedoms.
As a User you have the right to access, rectify, delete and oppose your personal data, which you can exercise by writing to us at email@example.com.
🗑 6. Deleting and terminating your Account
You may delete your Account
As a User, you are free to terminate these Terms and delete your Account whenever you want and for no particular reason. We'll be very sorry, but all you have to do is write to firstname.lastname@example.org to delete your Account.
Soons can delete your account.
If you fail to comply with the Terms, legislation, or if for any reason we feel it is necessary, we reserve the right to delete your Account. We hope it will not come to that, but if it does, we will do our best to notify you in advance, but we cannot guarantee anything. In such an event, you will not be allowed to create a new Account.
Soons may deactivate your account.
We also reserve the right to impose restrictions on the use of the Services. For example, we may deactivate your Account due to unexpected security issues or long periods of inactivity (more than 12 months).
👁 7. Content reporting and removal
As a hosting company, we are not under a general obligation to monitor the information we store. However, if you believe that any Content is illegal or inappropriate, we invite you to report it to us or to the User who is the author by writing to us at email@example.com.
This is particularly the case for any Content of a sexual and/or child pornographic nature, calling for hatred, terrorism, violence in general or against a group of people in particular, inciting others to endanger themselves or provoking suicide.
Removal of Content
We reserve the right, at any time and without notice, to remove or suspend temporarily or permanently access to any Content, which does not comply with the law, these Terms, or which violates your rights, those of another User, a third party, or Soons.
📺 8. Availability, operation and modification of the Services
Availability of the Services
Without being able to guarantee it, we strive to provide you with continuous access to the App. However we may at any time and without liability to Soons: (i) suspend, discontinue or restrict access to all or part of the App, restrict access to the App, or parts of the App, to a particular category of Users; (ii) remove any information that may disrupt its operation or contravene the law, or our Terms; (iii) suspend or restrict access to the App in order to make updates. If this happens, we will try to notify you in advance, but it may not be possible.
Soons is also not responsible if the App is not accessible due to an event beyond its control (such as force majeure, a problem on the User's server, technical difficulties, disruptions to the internet network).
Functioning of the service
Without being able to guarantee it to you, we endeavour to maintain the good functioning of the Services and to avoid the disturbances.
The Services are provided on an "as is" and "as available" basis and (to the extent permitted by law) without warranty of any kind, either express or implied, including, without limitation, implied warranties or conditions of satisfactory quality, merchantability, fitness for a particular purpose, title, quiet enjoyment or non-infringement, or arising from course of dealing.
In addition, while Soons attempts to provide you with a good user experience, we do not represent or warrant that: the Services will always be secure, error-free and timely, that they will always operate without delay, disruption or imperfection, or that any Content or information you obtain through the Services will be current or accurate.
Changes to the Services
We are constantly improving our Services and developing new features to ensure you have the best possible experience on Soons. This means that we may add or remove Services at any time, as well as suspend or discontinue a Service. We will try to notify you in advance if we do this, but it may not be possible.
🔮 9. Third Party Services
Soons uses third-party vendors and hosting partners, including to provide the hardware, software, networking, storage and other technology necessary to run the Services.
If you use any feature or service operated by a third party and made available through our Services (including any Services we may offer jointly with that third party), the terms of each party will govern their respective relationships with you. Soons shall not be responsible for any terms imposed by any third party, nor for any actions taken under such third party's terms, nor for any technical problem and/or security breach originating from such third party.
🧠 10. Intellectual Property
With the exception of Content generated by Users, the App is the exclusive property of Soons. As such, we retain all intellectual property rights relating to it, including its Services, Content, software, structure, design, interfaces, databases, texts, trademarks, but also more broadly to the design and documentation of Soons, as well as to the related intellectual property rights (including, without limitation, all patent rights, design rights, copyrights and trade secret rights).
Accordingly, as a User of the App you agree not to engage in any act of reproduction, dissemination, reverse engineering, disassembly, decompilation or use of all or any part of the App in any form whatsoever, unless we have given you prior written permission.
✏️ 11. Modification of the Terms
Soons reserves the right to modify its Terms at any time, in particular in order to adapt them to changes in its operations, legislation or the Services offered.
In this case, Soons will inform you of the new versions of the Terms and you will be invited to read them and then to accept them according to the process set up.
You are of course free to reject the new Terms. You will then no longer be able to use the Services, nor will you be able to hold Soons liable for any damages.
If you use the App and its Services after a modification of the Terms, this will be considered as your acceptance of the new Terms.
🏛 12. Applicable law and jurisdiction
If you have a complaint or a problem with Soons, contact us first at firstname.lastname@example.org, we will do our best to answer or solve it.
If the problem persists, the European Commission has set up an online dispute resolution platform, facilitating the independent out-of-court settlement of online disputes between consumers and professionals in the European Union that we encourage you to use. This platform is accessible at the following link: https://webgate.ec.europa.eu/odr/
If you wish to take legal action, you and Soons agree that these Terms are governed by French law and that the French courts shall have exclusive jurisdiction over all disputes and claims (whether contractual or otherwise) arising out of or relating to these Terms or the use of the Services.
Any provision of these Terms that is found to be unenforceable, will be severed from these Terms, but will not affect the validity and enforceability of the remaining provisions.
